Scott Willis Published in the American Law Institute Continuing Legal Education’s Magazine, The Practical Real Estate Lawyer

Fishman Haygood partner Scott Willis’s article, “Managing Professional Liability Risks in Preparing Legal Opinions,” was published in the March 2025 issue of the ALI CLE’s The Practical Real Estate Lawyer. The rendering of a third-party legal opinion, like other attorney responsibilities in connection with closing a real estate secured finance transaction, involves professional liability risks. In the article, Scott discusses how an opinion preparer’s use of due diligence and the inclusion in its opinion of customary assumptions, qualifications, limitations, and exclusions helps to minimize these risks.
