October 2025 Court Opinions Recapped on Tad Bartlett’s Take the Fifth Blog

Partner Tad Bartlett, head of Fishman Haygood’s Appellate Section, has published his October 2025 summary of opinion statistics from the U.S. Court of Appeals for the Fifth Circuit. These statistics are based on 204 total opinions released by the Court. Click here to read more on his Take the Fifth blog.

In addition to tracking opinions by district-court-of-origin, case-type, and individual judge workload and contributions, Tad has introduced a new statistical feature beginning this month: tracking the effect on appeal-outcome and plaintiff/defendant benefit for cases orally argued, cases where oral argument is ordered and then withdrawn, and cases where argument is never ordered.

Our lawyers handle appeals for both plaintiffs and defendants in civil litigation across many subject matters, in review of administrative proceedings, and, as part of our pro bono commitment, in immigration and post-conviction proceedings. The appellate practice at Fishman Haygood is not limited to representation before the appellate courts but also includes advising clients and their trial counsel on litigation issues to ensure proper preservation of appellate issues at the trial court.
