Fishman Haygood’s Jason Burge Argues Before Eleventh Circuit in Insurance Dispute Appeal

On April 22, 2026, Fishman Haygood Partner Jason Burge presented an oral argument before the U.S. Court of Appeals for the Eleventh Circuit in GoAuto Insurance Company v. 2B Claims Services, Inc. The case, which was heard in Atlanta, is now under advisement.

The appeal arises from a dispute in the Northern District of Florida concerning the alleged negligent handling of third-party claims by an independent adjuster. Fishman Haygood represents GoAuto Insurance Company, which brought claims against 2B Claims Services, Inc. seeking to recover approximately $240,000 in extra-contractual payments.

The district court granted summary judgment in favor of 2B, concluding that the independent adjuster owed no duty to protect GoAuto from extra-contractual exposure. Fishman Haygood is now challenging that decision on appeal, presenting the Eleventh Circuit with important questions regarding the scope of duties owed by independent adjusters in the claims handling process.
