Fishman Haygood Pursues Claims Against Student Loan Servicer Navient in Puerto Rico

On August 18, 2023, Puerto Rico’s Attorney General Domingo Emanuelli Hernández filed a lawsuit against Navient Corporation and Navient Solutions, LLC (“Navient”) for improper servicing of student loans under the Consumer Financial Protection Act. The suit alleges that Navient violated federal and state law by engaging in several distinct types of wrongdoing, including the origination of subprime loans that it did not expect students to be able to repay; steering students into forbearance, rather than income-driven repayment; servicing failures relating to recertification; misrepresentations relating to co-signer release; and payment processing errors. In a press conference on August 22, 2023, the Puerto Rico Department of Justice indicated that at least 20,000 students residing in Puerto Rico have been impacted by Navient’s allegedly deceptive practices. Thaizza Rodríguez Pagán, special assistant in the Secretary of Justice’s Office, called the company’s conduct “abusive and irregular.” Read more in this Puerto Rico Hoy article.
