Lori Mince Moderates Panel on Disabled-Access Lawsuits

Fishman Haygood Partner Lori Mince moderated a recent panel at the 2015 ABA Real Property, Trusts & Estate Spring Symposium held April 31-May 1 in Washington, D.C.

The panel discussion titled “Disabled-Access Lawsuits: Private Enforcement or Private Extortion?” focused on the growing rise of lawsuits related to federal disability law accessibility requirements. Panelists included lawyers representing plaintiffs and defendants in these cases, as well as a representative from the Department of Justice’s Civil Rights Division, Disability Rights Section.

The panel provided an overview of the requirements for compliance under Title III, including which businesses and facilities fall under the federal law’s purview. The discussion also highlighted the biggest myths related to Title III accessibility compliance, ranging from misconceptions regarding grandfathering of structures to reliance on contractors and/or architects to monitor structural compliance.

Lori currently serves as President of the Real Property Litigation and Alternative Dispute Resolution Committee of the ABA Section of Real Property, Trusts and Estate Law.
